A Wake-Up Call for Fire Safety Compliance

The East Sussex Fire and Rescue Service (ESFRS) has successfully prosecuted a residential care company for serious fire safety violations, highlighting the crucial importance of adhering to fire safety regulations. On 9th July 2024, Brighton Magistrates Court fined Care Pro (Southeast) Limited and its directors £124,455 for multiple offences.

What Happened?

ESFRS officers conducted inspections at several properties managed by Care Pro (Southeast) Limited, including Park Apartments, Eden Lodge, Park View, and Beau Lodge in Bexhill on Sea. They found significant breaches of the Regulatory Reform (Fire Safety) Order 2005:

  • General fire precautions: Failure to take necessary fire safety measures.
  • Risk assessment: Failure to properly assess fire risks.
  • Fire-fighting and detection: Failure to provide adequate fire-fighting and detection systems.
  • Maintenance: Failure to maintain fire safety equipment.

The court deemed the company's negligence as highly culpable, with a medium level of potential harm due to the risks posed to vulnerable residents. The directors were fined £27,500 for each major offence, plus additional costs, bringing the total to £124,455.

Key Takeaways from the Court

District Judge Szagun highlighted the serious risks posed by faulty fire doors and inadequate alarm systems, stressing the need for operators of residential care facilities to fully understand and comply with fire safety regulations.

George O’Reilly, ESFRS's Area Manager of Fire Safety, expressed gratitude to the court and his team for their hard work. He reiterated ESFRS's commitment to enforcing fire safety laws and taking legal action against those who endanger lives by neglecting these crucial requirements.

Craig Williams, Group Protection Legislation and Enforcement Manager, called this one of the most serious cases ESFRS has prosecuted. He warned property owners and managers about the severe consequences of failing to comply with fire safety laws, including hefty fines and potential jail time.

The Importance of Fire Safety Compliance

This case serves as a stark reminder of the importance of following fire safety regulations. Recent legislative changes through the Building Safety Act 2022 have strengthened the responsibilities of those in charge of premises. All responsible parties must conduct and document thorough fire risk assessments, considering the safety of everyone on or near the premises.

These regulations apply to all non-domestic properties, such as workplaces, visitor accommodations, and communal areas in multi-occupied residential buildings.
