Our Terms and Conditions

1. This document sets out our Terms of Business (“the Terms”) which apply in all cases in addition to any other terms of engagement of which we may notify you in writing.

2. RTJ OF SUSSEX Ltd is trading from 126 Wish Hill, Willingdon, Eastbourne BN20 9HL.

3. This quotation is valid for 30 days from date shown hereon.

4. This quotation provides for the work being carried out continuously during normal working hours (Monday to Friday 8am – 5pm).

5. Should it be desirable or necessary to execute any part of the agreed work outside normal hours, this must be agreed in writing in advance.

6. In the event of work being conducted outside of normal hours the quotation price shall be increased accordingly and notified to you in writing.

7. Alterations, amendments, or additional work will be agreed in writing prior to being carried out and will be subject to additional cost.

8. In the event of any overdue payments in respect of any account between you and RTJ OF SUSSEX LTD, RTJ OF SUSSEX LTD reserves the right to cease work until that account is brought up to date.

9. Title to all goods only passes to you upon receipt of cleared funds in relation to all accounts between you and RTJ OF SUSSEX LTD.

10. Until receipt of said cleared funds ownership of all goods and equipment supplied by RTJ OF SUSSEX LTD remain the property of RTJ OF SUSSEX LTD and must be kept insured, secure and in good working order.

11. In the event of non-payment of any account, RTJ OF SUSSEX LTD reserves the right to remove any and all necessary goods sufficient to settle any overdue amount and the costs of sale.

12. If, for any reason, the work does not proceed to completion, we will be entitled to charge for work done and for materials incurred. Our fee will be calculated on the basis of actual time recorded plus VAT and material costs.

13. Interest will be charged on a daily basis at 8% over Barclays Bank base rate from time to time, or pursuant to the Late Payment of Commercial Debts (Interest) Act 1998 (if applicable), whichever is the greater, from the date of the overdue payment in cases where payment is not made in accordance with our payment terms.

14. If any provision of the Contract (or part of any provision) is or becomes illegal, invalid or unenforceable, the legality, validity and enforceability of any other provision of the Contract shall not be affected.

15. No failure, delay or omission by RTJ OF SUSSEX LTD in exercising any right, power or remedy provided by law or under the Terms shall operate as a waiver of that right, power or remedy, nor shall it preclude or restrict any future exercise of that or any other right, power or remedy.

16. Except as explicitly provided for by the Terms, it is agreed that no rights of enforcement of these terms are conferred upon any third party, and pursuant to Section 1(2) of the Contracts (Rights of Third Parties) Act 1999 any third party right of enforcement is expressly excluded.

17. Any dispute or claim arising out of or in connection with the Terms, subject matter or formation shall be governed by and construed in accordance with the law of England.

18. Each party irrevocably agrees that the courts of England shall have exclusive jurisdiction over any dispute or claim (including non-contractual disputes or claims) arising out of or in connection with this guarantee or its subject matter or formation.

19. Your continuing instructions in this matter will amount to acceptance of the Terms.
